Acceptable Use Policy

Introduction
This Acceptable Use Policy ("AUP") governs your use of the Genkō platform and all associated services. By using Genkō, you agree to comply with this AUP. Violations may result in suspension or termination of your account and, where applicable, referral to law enforcement or regulatory authorities.
Permitted Uses
Genkō is designed exclusively for healthcare practice management. Permitted uses include:
Clinical Administration
Scheduling and managing patient appointments, maintaining patient contact records, coordinating provider availability, and sending appointment reminders.
Practice Operations
Managing staff accounts and roles, configuring appointment types and durations, generating analytics and reports, and administering billing and subscription settings.
Patient Self-Service
Providing patients with a booking portal to schedule, reschedule, or cancel their own appointments in accordance with your practice's policies.
Integrations
Connecting Genkō with authorized third-party services — including calendar providers, payment processors, and AI assistants — through our official integration framework.
Prohibited Uses
The following activities are strictly prohibited on the Genkō platform:
Unauthorized Access
Attempting to gain unauthorized access to another user's account, organization data, or Genkō's systems, networks, or infrastructure.
Data Scraping and Automated Abuse
Using bots, scrapers, or automated tools to extract data from the platform, bypass rate limits, or submit fraudulent sign-ups or bookings.
Misrepresentation
Impersonating a healthcare provider, creating accounts with false information, or representing unauthorized organizations.
Unlawful Storage of PHI
Storing or transmitting Protected Health Information without first executing a Business Associate Agreement with Genkō, or in violation of HIPAA, HITECH, or applicable state health privacy laws.
Harmful Content
Uploading or transmitting content that is defamatory, fraudulent, harassing, threatening, obscene, or that infringes any third-party intellectual property rights.
Interference
Taking any action that imposes an unreasonable or disproportionate load on Genkō's infrastructure, disrupts service for other users, or circumvents platform security measures.
Resale and Unauthorized Distribution
Reselling, sublicensing, or distributing access to Genkō without express written permission, including white-labeling the platform for third parties.
Regulatory Violations
Using Genkō in a manner that violates applicable healthcare regulations, including HIPAA, HITECH, DEA regulations, state licensing laws, or telehealth practice standards.
Healthcare-Specific Obligations
Because Genkō processes healthcare data, users must additionally comply with the following obligations:
Accurate Patient Information
You must ensure that patient records are accurate, complete, and maintained in compliance with applicable healthcare documentation standards. Do not input false diagnoses, fabricated records, or misleading clinical information.
Scope of Practice
All clinical activities scheduled or coordinated through Genkō must be performed by properly licensed and credentialed practitioners within their legal scope of practice.
Informed Consent
You are responsible for obtaining all required informed consents from patients, including consent to receive electronic communications and appointment reminders through Genkō.
Minimum Necessary Access
Staff accounts must be configured with the minimum permissions necessary for each role. Do not grant elevated access to users who do not require it for their job function.
Reporting Violations
If you become aware of a violation of this AUP — whether by another user, an unauthorized third party, or a potential security incident — please report it immediately to security@getgenko.com. Include as much detail as possible: affected accounts, timestamps, and a description of the activity. Reports may be made anonymously.
Enforcement
Genkō reserves the right to investigate suspected violations of this AUP and to take appropriate action, which may include:
Warning
Issuing a formal warning and requiring remediation of the violating activity.
Suspension
Temporarily suspending access to the platform while we investigate or pending corrective action.
Termination
Permanently terminating your account and organization access for serious, repeated, or unresolved violations.
Legal Action
Referring violations to law enforcement, regulatory authorities (including HHS Office for Civil Rights), or pursuing civil remedies when required by law or warranted by the severity of the violation.
Changes to This Policy
Genkō may update this AUP at any time. Material changes will be communicated via email and posted at getgenko.com/legal/acceptable-use with an updated effective date. Continued use of the platform after notice constitutes acceptance of the revised policy.
